Include wife's name as joint property in Husband's personal House.

Hi, I am facing trouble as my husband constantly tortures me because the house where I live with him is in his name.(The land property is in his name). He threatens me and my children to throw us away from the house every now & then. We are very scared that he might bring his relatives or sell the entire house and go and reside with his relatives leaving behind nothing for us. Is there some way that I can make the land+house property in jointly in our name(husband+wife). Please suggest if anything related also to this we can do to protect my & my childrens future.

First go to police to lodge a complaint against your husband with brief of allegations in the form of application. Than approach your lawyer who will file a case under Domestic Violence Act against your husband to get relief as per the provisions of the said act.

First of all you won't have to leave this house because even the flat is on his name he can't remove you as you are legally wedded wife. You can move to court and can take number of protection orders including residential protection under Domestic Violence Act. Also file complaint against him under the penal provisions.

Please also let us know the status of your marriage/ dispute between you and your husband.

At this stage, you can opt to file for Domestic Voilance Claiming your matrimonial interest and your childrens interest in the property. You can file an application for injunction, so as to not allow any transfer or change of ownership.

Further, in your divorce proceedings you can claim interest in the property and also show husband is having more than one propety as per his income tax records ir otherwise. children's claim can be asked jointly. moreover you can also claim maintainance along with the same application, as per law.
