Illegal road construction on private property without permission.

My mother is Muslim who was from West Bengal, and is Currently residing in Mumbai. She owned a land at WB on which local villagers have constructed a concrete Road through her land for their personal use without any notice or asking her permission. They constructed it by taking advantage of her absence. We can sue, but not sure who to blame and not sure if we would even get anything in return. Plus it will be hard to travel to WB regularly from Mumbai for court procedures.What is best we can do ?

firstly give a detail representation to the local administration panchayat/municipality stating the whole incident and illegally. if they don't respond within a specific time period then you can file a writ petition before the High Court against the authorities. This will solve your problem.
