Illegal occupation of society flat by society employee.

17-Oct-2023 (In Property Law)

The MC of our society has given one of the society flats to one of the employees to which I objected and complained to the RCS.RCS has ordered to get the flat vacated within a month but I doubt about compliance of order. Please advice next course of action and at which level it should be done. Also I had demanded that common service charge should be recovered from that employee as he has been getting the same facilities like other residents which was rejected by the MC saying that it does not apply to the society flat but they are taking nominal rent from him.plz advise.

You can again complain to the Registrar Cooperative Society or file a writ of mandamus in the high court of your concerned state.
You should also write about the common service charge to the registrar.

If the Registrar has already directed for his eviction, then you can approach the High Court for non compliance of the said order. You can raise the issue of charges also in the said petition.
