Illegal occupants in my deceased aunt's house. I'm her nominee

My aunt's (Tai G) house is in chandigarh, She passed away last year. I'm her nominee but her brother has illegally occupied the house and not ready to leave. She has not written any Will but when she was alive I used to pay her water and electricity bills from Delhi as my mobile no. was updated in her bills and I was also her bank nominee. I want to file a case against her brother. Kindly suggest can I file it from Delhi?

hello anuj
as ur saying tht your tai ji passed away last year .in chandigarh.you are the person who is been mentioned her nominee every where in his documents as well as in her bank also. it is possible only in the conditions if she has other property in delhi then it can be done

if there is no will made by your aunt, then the property will be divided intestate as per the succession laws prevalent in India. the property will devolve upon you or her brother or jointly , depending upon the nature of property as well.
