ILLEGAL CONSTRUCTION WITH DEVIATION,BREACH OF CONTRACT,DELAY

We,6 owners of a housing board building in chennai entered into a JV with a builder in 2013 for construction of 8 flats, giving him power to sell 2 flats. He has sold 2 flats and in construction has violated in rear set backs from approved plan and has not complied with CMDA regulations. Till now he has not taken any steps to rectify the deviation and hand over the flats. Can we lodge a criminal case against him or what are the alternatives?

You can send legal notice through an advocate asking the builder to comply with the cmda approved plan. Further you can set a time frame to complete the project and hand over possession. There has been a long delay. Reply to the notice must be given within 15 days time. Depending on the reply from the builder you can take further steps.

there is a separate legal form for violation of Builders in this case it is called as real estate regulatory authority Pizza situated in Egmore for all over Tamilnadu and for Andaman and Nicobar Islands so you said that you are constructing 8 plazzo jurisdiction will come under the State Authority so you should file a case that released a tatha Rati for the killer deviation and for not handing over the possession they will make proper arrangement to demolish the illegal arrangements and to construct at the proper time it is stipulated time and handover the processor
