If construction is being carried out during pendency of a civil suit, you must act immediately. Delay will weaken your position. Immediate Legal Steps: 1. File an urgent Interlocutory Application (I.A.) under Order XXXIX Rules 1 & 2 CPC seeking temporary injunction restraining further construction. 2. If construction has already commenced, seek: Status quo order Ad-interim ex parte injunction Police aid for implementation, if required. 3. If a “fake decree” is being relied upon: Obtain certified copy immediately. File application to set aside decree (if ex parte) or Initiate proceedings alleging fraud upon court (a decree obtained by fraud is null in law). 4. Simultaneously submit written objection before Municipal Authorities requesting immediate stoppage of construction citing pending litigation. 5. If there is threat or intimidation by land grabbers, lodge a police complaint and seek protection. Courts take ongoing construction during litigation very seriously. If you move urgently, you can secure an interim stay before irreparable damage is caused. Do not wait until March. File for emergency injunction immediately.
