Illegal construction by builder

I gave my house to a builder in collaboration agreement in 2011 According to agreement if he didn't complete the construction by 2014 then the agreement will be canceled So he didn't completed the construction because it got booked by mcd under unauthorized contruction upto third floor in 2012 So there is only structure with parking , stilt floor , first floor , second floor , third floor and roof Now it has been 5 year the agreement got cancelled Now I want to demolish the structure Bec it is illega and I am not able to sell the plot So if I demolish the structure can builder take me to court or I don't have to be scared of him and can easy demolish Bec it's illegal structure

as ur saying that u have done a aggrement with the builder as per agrrement you made in 2011 with tye builder that if the builder is not able to complete the construction till 2014 in that condition the agreement will.become null and void and the construction will be decleared illegal . and the ownership willbe regained by you again. there is glith in this agrrement as per which ypu nees to take permissiom from the court for the execution of uragrremeny null an dvoid claues
