Illegal construction as per society

I have purchased the shop from a doctor, who had earlier purchased it from the builder. I possess the full chain of ownership documents—from the builder to the doctor, and from the doctor to me—along with properly stamped and registered sale deeds. The building where my shop is located is still under the builder's control, and the society has not inducted us as members. The builder assures us that there is no issue, but we still want to verify and confirm the legal status to ensure everything is

If a society has been formed then you must apply for a membership by virtue of you having purchased a premises. In fact it is as and by way of your right if you are paying maintenance. Feel free to contact me for seeking any legal advice as regards the same.

Since you have a full chain of ownership documents and all sale deeds are properly stamped and registered, your title appears legally valid. However, the fact that the society has not inducted you as a member and the builder still controls the premises raises red flags about the final conveyance and handover process. I recommend checking the building's Occupancy Certificate (OC), Completion Certificate (CC), and verifying if the society has been legally formed and registered. You may also issue a legal notice to the builder or approach the registrar for society membership enforcement.

Well, the Building in which you have a shop now needs to be under the control of Society rather than Builder controlling it. Thus, all the flat & shop owners needs to form Society including you & need to go for Conveyance or Deemed Conveyance! Now, also you are the owner of shop, but, once society get registered, you will become more safe and will get Share Certificate.
