How will grandmothers property be divided when she is alive

08-Dec-2023 (In Property Law)
My grandmother has got 3 daughters and two sons. Elder son died few years ago but he got a son and one of the daughter died few years ago and she got a son. Now my grand mother wants to distribute the land as per her wish ( not sure if it is possible) but my grandmother is still alive and land is in her name and she want to keep some land with her itself and most of the land she want to give it to younger son and rest to her daughters who are still alive. So is it fair to proceed legally with the above distribution? What if one of the expired daughter's son demand for land distribution for his need? What if one of the expired son's son demand for land distribution? Please provide recomended approach to distribute the land as per legal laws

It is not clear whether your grandmother's property is ancestral or self-acquired. If ancestral, all persons claiming through her who were alive on the date of devolution of property upon your grandmother, including any child in womb, would be entitled their respective equal shares. If self-acquired, your grandmother will be legally entitled to dispose of the property in any manner she deems fit.

self acquired property of a person can be distributed, settled, gifted, transferred to any individual, either male or female as per the wishes of the title holder of the property. Nobody has any legal right to question until the owner is alive. Inheritance issues will arise only after the death of the title holder

Your grand mothers property may be her own self acquired property or she might have got it from her husband or from her parents. If it is self acquired she can give it to any body of her choice. But if it is inherited then all her children have a right . In the case of deceased son or daughter their children have got a right as the heirs.
