How will fathers property be divided after fathers death b/w 2 sons

We are hindu by birth. My father bought 500sqmt property in Darbhanga, Bihar. Currently I (38yrs) along with my wife (35yrs), my son (10 months), my daughter (7 yrs) living in Delhi and i earning bread and butter for my family without any financial help since 12 years. Father is no more now (died in 2013). My mother (68yrs), younger brother (34yrs) and his wife (33yrs) living in Darbhanga. Younger brother is Bank Manager nearby Darbhanga. I want to get half part of my father's property for sell and buy own property in Delhi. Is it possible? Please advise.

Yes it is possible. Contact a good lawyer with all facts/details/documents and file a partition suit . However before excersising this option, I advice to sit with your brother and mother to get solution.

Dear sir,
property of a male Hindu dying intestate (without will) shall devolve according to the sec-9 of Hindu succession Act'1956.
you should file suit for partition for you share in the property. the property of your father will be divided equal between your mother, brother and you.
