How to transfer flat in my father and my name

My mother died intestate. We are Hindus. My father , brother and me are the legal heirs. My brother does not want share in mother's flat. How to transfer flat in my father and my name?

To transfer the flat of your mother in you and your fathers name , get heirship certificate and then tell your brother to release his share in the said property in favour of you and your father by registered document.

In this case you can go forheirship certificate by filing an application in the court. You three can make an application against no one. This process for granting the heirship takes 8 to 10 months period. Here you have to pay the stamp duty, which is calculated as per the valuation of flat.

Apply to talathi office and file mother's death certificate.Also file previous title extract having mother's name on flat and make sure whether she had not appointed amy nominee. If not then give entire names of family members. They will issue notice to each one and once receive no objection from your brother, they will put the name of yours as owner including other members.

Firstly check with the building secretary the name of the nominee regarding the flat. Incase no nominee is present then you need to get Succession Certificate and your brother's NOC stating that he is not interested in the flat and he surrendering his rights on the said flat.
