How to sue for illegal encroachment of land by roads authority

If you are the owner of the property and without following the due procedure of law the government doing construction on the road then you have two options first you can file application before the collector for compensation if you want but the compensation would be very less price of the land second if you don't want the compensation then file the objection before the collector that without follow the due procedure prescribed under land acquisition act amended in 2013 the government can not construct the road upon my personal property and if collector not takes any action then you can file a writ petition before the Hon'ble High Court for restricted the government to construct the road.
I must tell you that mostly construction of the road in the villages is going on under the provision of pradhan mantri gramin sadak yojna under which government can not construct the road on the land which is completely belongs to the private person and there is no use of the land as publicly. The government only construct the road on the land which is commonly used for public only such land can be use for construction of the road otherwise it's illegal. So you take the information that under which scheme government constructing the road it will help you better.

You should go for a civil suit if your land is taken by government for public use they have to follow the procedure of land accusation and have to provide the compensation as per government rates.imadately go for a civil suit
