How to sell property after partition

25-May-2023 (In Property Law)
My father has two brothers and five sisters among them only three sisters are alive. In 1980 property was partitioned giving money to all sisters. One brother took money and went away. Among remaining two orally divided in front of family elders and village leaders and whole records are with that leader if village. Now my father is aged and want to sell his property but no records, no clear titles. How to start the process. Guide me please

Hi, On whos name the property is registered now? You need to apply EC against the survey number and check the registration details. If it is not registered on your father then you can not sell. It is huge process to make the records to register the property on your father. We need discussion on this

How can village leader can keep original documents related to your property. If partition has taken before them means they are liable to witness only partition among your family only and they can't keep the original documents or records of your property. Did you ask about the records with him, how can you so ignorant and reckless about your own property that you don't even have clear titles. Some thing is fishy that's why you are facing this problem. You or your father can't sell the property without clear titles.
