Removing a stay order on property in India requires approaching the same court that issued it. The process begins with obtaining and reviewing the stay order to understand why it was granted such as a property dispute, pending litigation, or unpaid dues and what restrictions it imposes. A property lawyer can help you prepare your case, gather ownership documents, contracts, or proof of changed circumstances, and file an application to vacate the order.

If the stay was granted ex-parte (without hearing you), your lawyer can seek its removal on that ground. You must attend hearings where the court reviews arguments and evidence. In some cases, negotiation or settlement with the opposing party may be a faster solution. If the lower court refuses to lift the stay, you can file an appeal before a higher court. Legal guidance is essential for improving your chances of success.

You can get the stay vacated from the same Court depending on the merits of the case, however with out knowing the details of the case we cannot make any conclusive comments. Better engage an Advocate. Regards Taji George

You need to go to a lawyer with the entire facts of the case, including a copy of the stay and the petition under which it was granted. If reasonable grounds can be made out as to why the stay should be vacated, it can be done.
