How to relinquish my rights in a joint property
04-Jun-2025 (In Property Law)
I want to relinquish my rights in a property which is jointly held by my sister, cousin brother and myself. There is no monetary consideration asked for or paid by any party. We are Hindu.
How can I get this done please.
To relinquish property rights held jointly with siblings & your cousins, you can execute a relinquishment deed or a release deed. This deed must be registered with the relevant authorities, and it's a legally binding document that transfers your share of the property to your siblings & cousins.
As a Hindu co-owner of a jointly held property, you can relinquish your share in favour of the other co-owners—your sister and cousin brother—through a Relinquishment Deed. Since there is no monetary consideration, it will be treated as a gift of your share and is legally valid among family members under Indian law.
Steps to proceed:
Draft a Relinquishment Deed, clearly stating your intention to relinquish your share in the property in favour of the other co-owners, without consideration.
The deed must include details of the property, co-owners, and your share.
Get the deed executed on stamp paper of appropriate value, as per the state’s stamp duty laws. Stamp duty may vary—some states charge concessional rates for transfers among family members.
The deed must be signed by all parties and witnessed by at least two persons.
Finally, get it registered at the Sub-Registrar’s Office where the property is located.
Registration is mandatory to make the relinquishment legally enforceable. Once registered, your name will be removed from the ownership records.
