How to prevent property papers to be submitted in court

23-Jul-2023 (In Property Law)
When my brother files a partition suit on my property(house, land, etc) even if all the properties are in my name, the court asks to submit all those property papers in the court. My question is, is there any solution so that I do not have to submit those papers in the court. Basically, I need to take a home loan but there has been a partition suit filed on the land.If I submit the land papers, then I can't take a home loan.

Hello. In order to prove it to the court that it is your self acquired property and to prove that all the properties are in your name you have to submit the documents to the court. And for your bank loan and all you can get certified copies from the court after you submit your documents. Make sure you appoint a good lawyer. Thank you

when property documents have been pledged/mortgaged or given as security for the loan, citing the same reason you can produce the certified copies of the documents obtained from the Sub-Registrar to the Court.

Sir, when the court has order you to submit the property papers you should submit the same in court, they will be returned after evidence and it will be just and good to follow court orders, if not submitted the case might be against you, for taking loan you can take a apply a true copy in the sub register and submit the same for loan, it is valid and bank will consider the true copy for granting a loan.
