How to get transfer of ownership of property which is on mortgage.

we own a house under my moms name and it is currently under mortgage and want to transfer the property to my Name
The mother of applicant has mortgaged the property to third party. She has to redeem the mortgage from the mortgagee in the sub registrar office and get free from the encumbrance, thereafter she is entitled to transfer the property in the name of his son.

your mother can gift the property to you for which a gift deed need to be registered, mortgage will not come in your way as you simply step in to the shoes of your mother once the gift deed is registered and the liability of mortgage will be on you instead of your mother

sir/madum, Firstly, the mortgage made by your mom has to be re- deem from the mortgagee. Then, you have to get transfer to your name by your mom either under gift deed, sale deed etc,.as per understanding between you.
