How to get power of attorney for the Gujarat property

21-Sep-2023 (In Property Law)
There is Property of my Nani, my Nani has 2 sons and 1 daughter. Daughter took care of her mother till her last breath, so Nani made a WILL constituting that all the 6 property of Gujarat belongs to her daughter. But before making this WILL Nani gave Power Of Attorney to his 2 sons. And Daughter signed on the document consisting that there is no such ownership right of her. Currently Nani passed away, and daughter wants Power of attorney of the property but she doesn't have the copy of Power of Attorney. Can she claim the right to have Power of attorney?

from the provided instances it is very much contradictory and controversial with regards to the ownership and the rights which are possessed in the property of the daughter and the sun but bring this to your kind notice that only if either of will ir power of attorney are registered then the register document will have more validity comparatively the will which is executed after executing power of attorney is is to be considered as final, power of attorney is not also something which gives all the rights of ownership to the Attorney holder attorney is basically the Agent of the actual owner Dabangg proper details of ownership and other rights and responsibilities which have been mentioned in the will are required to be checked before a precise answer to the given controversy can be provided you may contact me for full consultation advocate Yogesh Bombay High Court 7020 479 749

all the power of attorneys given by your grandmother have become null and void after her death. her will has become enforceable now that she is no longer alive. your mother needs to go to gujarat and apply for the transfer of ownership based on the contents of the will. she might have to apply to the court for a probate or letter of administration depending on the requirements of the registration office in gujarat. all the best

Any Property which one transfers on the basis of General Power of Attorney is not legally valid. Suppose, If on the basis of the Power of Attorneys, whether special or general which were given by her to her two sons, properties of nanis were got transferred to someone else without execution and registration of sale Deed by the Buyer or Donee, then such transfers are illegal and invalid.
