How to form by laws of Resident welfare association for a society

Dear sirs, I am a member of a newly formed flat owner's association. While forming the by-laws , about the election of executive committee , it was discussed to put restrictions to allow only resident members to contest the election. Is it legally valid?. In future , is there a possibility that a non resident member question the legality of such clause of the by-law. please throw some light. Thanks in advance.

It is legally valid. How can a non resident member can contest in election?. And even they cannot challenge this clause.. It is only a general clause.

Association is for welfare of house owners.so, who are residents alone can contest election and do the needful for house owners.you can frame rules in this regard.contra rule is void.no person can question the same

It all depends upon the manner of forming the apartment association. Legally, after the association is registered, the flat owners together must register a separate deed of apartment, and on its basis form the apartment rules, but it is not in practice. So, If your association rules permit, It is valid.
