How to divide my grandfathers property

My grandfather and grandmother who has passed away,my family house then belongs to their two children my father and his brother only?? Their are two floors already and third floor constructed by my uncle since 20 years.As no name transfer and division of property done till now so it's in name of my late grandfather so should my father get rent of half third floor.How should the non built up area used and divided as they are having disputes over it.We are Hindu

If no division is done of the property which belonged to your grandfather then you can file a partition suit and get the property divided equally between your uncle and your father.

Venerated Sir,
I would like to inform you that as a legal heir you have right to hold ancestral property and also it moves amongst all legal heirs equally. As per amendment in Succession Act daughter have right in the property of father tends to ancestral. You have to file partition suit to decide property equally amongst shareholders. You can also make family agreement and registered it. On the basis of this you can get your right hessel free. Call for more legal help. Give feedback

It is a tough way. Technically, all children are equally entitled to equal share in their parents property. The property was 'gift' only to grandmother. Thereafter it converted into family property. Have a talk with the family members and try to have compromise.
