How to divide grandfathers property

We have house. we r staying from childhood and my father paying taxes but on the name of my grandfather name. House on his name but he expired . but my father elder brother not doing anything to house. We r saying to him we want to give share for him in house and we want house on my father name. So we can rebuilt newly. So what to do .

Sir,
1. In the instance, property belongs to your grandfather, then all his legal heir’s will claim equal share in that property.
2. Whereas you want that house property in your father’s name ,then only you can offer for purchase price
Therefore you are advised the below
1. First: discuss with your father’s elder brother, in a positive approach and explain him need to purchase the house and required his NOC or relinquishment deed, or property partition deed in sub-registered office of the property among the legal heirs .
2. Second: request them to enter a compromise deed among two brothers

HI
The property belongs to your grand father and the property after his death will devolve on his children(your father and his brother).
However you can have the market value of the property estimated by a government valuer and then pay your uncle his share of property value and get a relinquishment deed registered at sub registrar office.
once the relinquishment deed is done in your favour, you become the owner of the property and you can develop the property afresh.
