How to claim my right in my deceased fathers property
19-Jun-2023 (In Property Law)
I am only the daughter of my mother(late).my father got married and he had one son and daughter. Father had died. Now my step mother and their children are having the land. They are not giving anything to me. What is the way to stop getting benefits from land and how I can get my partition. How much I can get.
First you have to get legal heir certificate of your father including your name, if it is not possible file a succession suit for your father's property. That is to declare you are also the legal heir to succeed the property of your father with step mother and brothers. If court allows your claim, your father's property will be joint property. Thereafter you can file a partition suit along with an injunction petition.
Already your name in the legal heir certificate, directly file partition suit against step mother and step brothers for your share in the joint property.
