19-Jan-2025 (In Property Law)
When a wife pays for a property, the property is registered in her husband's name. The husband then does a gift deed in another woman's name, showing her as her wife. How does the wife challenge this gift deed in court? another woman is a govt employee in income tax department. I have filed a complaint in the police station and the income tax department also. legal notice is also sent to her. what else I can do?

You can challenge the gift deed in the court of law on the grounds of fraud, showing that the said property does not belong to the husband as the full payment has been made by you and he does not have any right or title in the said property. But in order to proof so you should have the proof to show that the transaction of the money has been done from your account with respect to the said property. You can only file a suit to recover the money from your husband. Boz you gave him money to buy the property under his name. Though it will be difficult to get the gift deed cancelled ! Kindly b in touch to understand the legalities Thanks

Ma'am you have not done the right approach till now. You must approach a lawyer and file a civil Suit for declaration, cancellation of gift deed and Permanent injunction alongwith an application for ad interim injunction and also seek recovery of possession of this property. police don't have competent power in property cases
