22-Sep-2023 (In Property Law)
My Grandfather left 2 plot in Palam Enclave measuring to 100 and 150 sq. yard . He had 5 sons and 1 daughter. Currently 2 son have constructed house in half the area of these plots 50 yards and 75 yards. One of the son i.e. My father lives in Ahmedabad and wants to claim his share, but no one is listening. One of the plot is in the name of Grandmother. Grandfather has made will. Can this will be considered.

Yes that can be possible, but in that case we need to know the whole facts and as well as that will too.
Exactly what he declared and how it is distributed amongst son and daughter that I don't know.
For any conclusion we need to discuss about this matter.

you have not mentioned that according to will who is the owner and presently who is in the possession. your grand father and grand mother are still alive or dies. before giving any reply these questions are needed to be answer.

You can definitely go ahead and claim the share if it's a undivided property and your father being one of the legal heirs was not being considered and his NOC has not been obtained. Therefore a suit for possession/declaration /damages and mesne profits can be filed right away. even a Criminal remedy can be availed. Thanks
