How can i claim share if property is registered in elder brothers name

Whether a brother will get share in property if the property is registered in the name of elder brother at the time of minor after father death

Sir, there are lots of things to be taken into consideration, like who purchased the property. Source of money. when Father expired, who were is legal heir etc. these types of cases cannot be replied in a 2 line question. Yes if your father has died intestate i.e. without making a will, the distribution of the property would be made in equal shares amongst both of you brothers. You can file a partition suit to claim your share or ask your brother to amicably gift you 50% of the property to you through a registered gift deed.
