Hindu family property- Legal heir disagreement with partition

Hi , We are from a hindu family . My grandfather had 9.8 acres of agricultural land and my grandfather have 2 sons including my dad. Recently my dad passed away and i came to know that there is an inequal seperation of the property between my dad and his brother. My dad's brother took 5.92 acres and gave us 3.92 acres. So as a legal heir i dont accept this partition. Still the property is in my dad's name. how to get the equal share in property? and what are the do's and don'ts that i have to keep in mind before filing a suit? and still the property earnings are enjoyed my dad's brother how can i take the control over property?. Some one please elaborate. so will there be any issue if my dad's brother is transferring my dad's share to my name while filing a partition suit?
