Help in getting back property : Property getting destroyed

My father rented out a building for commercial purposes in 2010, for a year. At the end of the contract, the tenant refused to move out. He filed a petition in the court that my father (who was partially disabled with stroke) threatened him. We hired a lawyer whom unfortunately kept on pushing dates and his non appearance , gave the tenant a stay order.
The building is not operational now for almost a decade. There is no sales nor any employees. Lack of maintenance for such a long time has made a lot of damages to the property. There was even a banyan tree growing on the top floor, which our neighbour removed because it threatened his adjacent property.
Could you please advise on how to get our building back from the tenant, is there possibility of getting damages fixed by the tenant?
your father can proceed with the petition seeking eviction of tenant and through that petition you can evict the tenant from the property and with respect to the damages caused to the building, you can claim against the tenant to make good the loss caused to you
