13-Jul-2023 (In Property Law)
Sir, my great grandfather (having 5 sons) died on 1946. My grandfather was 2nd number son. Elder brother (karta of my family) of my grandfather collected cash from all of his 4 brothers and aquired a plot in the name of his wife in 1964. Now nobody alive in my grandfather generation and my family is still undivided. Can we (rest of 4 brother's family) get share of the above mentioned plot ?

Yes . All rest four brothers are entitled to inherit the property of their late brother as he has no other legal heir in side. Irrespective of the fact that from which fund the property was purchased, after his death, having no direct legal heirs, brothers are his second line legal heirs and are entitled to inherit his property.

Yes it can be as the property is having nature of Hindu Undivided Family's property. All the stake holders have equal share in the property. Contact a good lawyer, apprise him about all facts, documents and act accordingly as per his advice.
