Grandfather died in 1979 property not distributed

21-Apr-2023 (In Property Law)
Our grandfather Mr. N Rao died in-estate in 1979. He had 6 children( 2 sons & 4 daugthers) who were all alive at the time of his death. He has a residential site at our village which he got through a family partition with his other 4 brothers in 1977. Out of his 6 children, 2 sons & 1 daughter have expired ( 1982, 2009, 2014). The deceased daughter has 5 children, while one of the deceased sons has 3 children and the other deceased son has 2 children. The husband of the deceased daughter has expired, while the spouses of the deceased sons are alive. The family now wants to peacefully distribute the property amongst themselves. Pl. let us know who all are entitled & what is the process?

Sir,

In your issue your informed that the property as came to your grand father under a family partition along with his 4 other brother.
Then your grand father share will be 1/5 of whole property.

You informed that your father have six children.

Therefore, the property obtained under a partition deed to your grand father, will be divided into equal 6 equal share.

in that each one get 1/6th share to their family. Even the persons died, the portion of the 1/6th of a deceases person will be divided further equally with his legal representatives

Please proceed.

Sir, IF you wish to claim a share in court asper succession, The family daughters children are entitle for notional share. So, IT is better to settle amicably among Y ourselves. If the extent is small and is impossible to divide , then. IT is better to sale and share The money.
