Getting Refund of token advance from builder

We have visited a builder and saw their apartment for sale. Upon enquiring on the amount, we are not satisfied with the quoted price. We asked them to reduce the amount and they said they have to mail the management to get the approval. They told us to pay the token advance of Rs2Lakhs and with which they can query the management to reduce the amount. We paid the amount and waited , but they didnt come back on the final quoted price. We repeatedly enquired in email as well but there was no response. So we decided to get back the token advance. Upon enquiring they told our amount is forfeited and will not get a refund. We have sent a registered post to get a proper reply and they are not even responding to the registered post. Can we move legally ? What can be the next steps ?
builder is violated the overall agreement and it is written under the email is there is any class for 4 fitting amount I must go through it remedies first you must give a legal notice to the Builder and if he is not refunding then you must approach Tamilnadu real estate regulatory authority by way of filing case to get the refund amount
