Forgery in paper that submitted in court

My husband file a declaratory suit for family property. But after 6 months we does not follow the case.after 3 year my brother in law submitted a affidavit of my husband with frod signs of my husband. And case is disposed by court in absence of my husband and his lawyer. Then what matter we file against my brother in law for this forgery ???
you can file an application under section 340 crpc to the learned for submission of false evidence and request the court to take cognizance of the matter and take action against the accused. When proven guilty they will be punished with 7 years of imprisonment.
