Forceful construction on undivided property by on of the 6 legal heirs. How to stop and what action can be taken and consequences and time frame

Hi,
You should issue a strongly worded legal notice to the concerned legal heir restraining him to stop the illegal construction and in addition you can seek partition of your share in the undivided property. Further better information is required

succession opens up on the death of owner of property acquired from his own funds when he died intestate. Then either you go for partition deed registered in the office of sub registrar or go to court in suit for partition, in case other legal heirs refuse to partition the property. Hard luck for you buddy. file suit for partition and stay.
