Father have 4 brothers how to divide share in grandfather's property

In my family all the land on my Dada Ji and some on my father and his 4brothers(taau and chacha ji) Is Legally possible all land now divided into 5 equal parts. My tauji name have some more land. Or only dadaji property will divided equally and rest as per name of 5brothers. Pls clear sir Combined Hindu family. My dadaji and all tau and chacha Ji died only my father alive.

Any property earned by an individual whether on account of own exertion or out of individual fund without investment of the HUF funds, is separate property of him/her and he/she is absolute owner of the property. if your taaujee and chachaji purchased the property from HUF funds then it may be property will come in HUF property and in this condition whole property can be divided in 5 equal parts as written by you. for all this some documents are to be seen khatian or sale deed of your grandfather's property and sale deed of your 4 chahajee's property, rent receipt or mutation paper etc so that it could be proved that whole property belongs to Joint Hindu Family.

Yes. If all the parties /stake holders are agreed then it can be partitioned on the basis of mutual consent or agreement. If it is not happen then you will have take recourse of law by filing of partition suit.
