Father gave his property to me via gift deed can brother claim rights
09-Aug-2024 (In Property Law)
My father did gift deed wirh registered agreement on my name so that after his demise there is no claim made by my step brother. Though currently my father and step brother are using the property and I will take possession only after his death. Will brother create an issue in giving me the property.
your situation indicates that there might be chances of dispute later on. I would recommend you to show the documents prepared in your favour and then we can decide the best course of action for you. I would recommend you to take some extra precaution in such situation either by getting more documents supporting your case.
What is the nature of the property, if it was ancestral or not? The brother in your case will need to file a Petition to make the Deed invalid.
If everything is in order, and it was a self-owned property of your father, then no issue shall arise.
To evict the brother in this case may be difficult if he has been living there for a long period of time. (The situation may differ from case to case, in a rare scenario the brother in this case may plea for adverse possession but it's not easy to prove the same.)

Yes if your brother has bad intentions then he can take legal advice n can generate some documents etc !
It’s better u shouldn’t sign any paper and also get all the property ingredients transfered in your name like water electric property tax etc !
Moreover don’t sign any paper at all until u get it read by your advocate
Plz b in touch
