Father died while back do we have share on grandfather's property

Sir, My grandparents house is a 60 gaj house in Tilak Nagar, West Delhi. My father died in July,2000. He had one brother and 2 sisters. My grand parents did not registered their property and not even made their will. They died before my father. We are two sisters only and my uncle has a son. I want to ask if my mother has any legal right on the property and how can she obtain it as patta of my grandparents name is with my uncle.what can he do with it. Kindly suggest asap. Because my uncle and his son are torturing my mother so that she ran away and they have full right on the property.

Incase your uncle is torturing your mother we can start by filing a complaint against him. Regarding your second query yes you have a right over the property and you and your mother have your lawful share vested in it. For more conclusive opinion please contact

Well it depends whether the property was a earned or ancestral , if it is ancestral you can claim your share by filing suit of partition, and if you are not having possession you have ti to also file suit of possession along with injunction suit restraining other s to interfere into that property

Yes you mother along with both of you have a right in the property as it is anot ancestral property
You must immediately file a case and take a stay on the property under the Hindu laws
Also if you are in possession of the property it is better that you file it sooner rather than later as it will secure your possession
Often people disposess the ladies of the house
