Father built house in mother's name how can we claim right on it

15-May-2023 (In Property Law)
My father had built a house back about 30 years and registered on my grand mothers name. She has 4 children - 2 Male and 2 Female and my father is the younger one. Both my grand mother and my father are deceased and the other 3 are alive. We want to have this property to be transferred in the name of my mother. Please advice us on how we can get this legally transferred with most economical option.

Hi
The surviving legal heirs( 2 aunts and 1 uncle) of your grand mother should gift the property to your mother.
that is the most economical option you have.
The reason is as per Hindu law, any property in the name of a woman is her absolute property.
in your case, your grand mother is the owner of the property even if your father has incurred all of the expenses pertaining to the property.
so after the demise of your grand mother all her legal heirs (i.e 2 aunts, 1 uncle and your father) are eligible for equal share of the property.
so in order to transfer the property to your mother's name all the surviving legal heirs( 2 aunts and 1 uncle) of your grand mother should gift the property to your mother.

you have to prove that the property was purchased by your father on your grand mother name, if your father brothers file a case. if they wont file a case your father has to be filed legal heir certification on his name and in that case your fathers brothers should not object and then your will be mutated on his name and after that your father can mutate on your mothers name.
