Family property transfer dispute

25-Sep-2024 (In Property Law)
40-45 years ago, my late grandfather transferred the ancestral property to his daughter (my bhuaji) on verbal agreement that she will transfer it back to his brother’s children (Me). Finally in 2016 my bhaji transferred the property to my father (gift deed) and then in 2021 my father transferred it to me (gift deed). But now, due to pressure from her Son, bhuaji is asking back her transferred property on the grounds that the transfer was made unknowingly. Is this possible for her to claim back?

Greetings for the day, In this situation, your aunt can claim the property through seeking cancellation of gift deed from the civil court. In order to safeguard your rights, you should approach the civil court first seeking declaration of your title in the said land.

Dear Sir, To proceed with the matter efficiently, I kindly request you to confirm two important details: 1. **Registered Ownership**: Please confirm in whose name the property is currently registered. This information is essential for determining the rightful owner and understanding the legal standing in this matter. 2. **Possession of the Property**: It is also important to clarify who currently has possession of the property. This will help us assess any potential challenges or legal issues related to possession, which may affect the transaction or any legal action we may need to take. These details will allow me to better understand the situation and provide you with precise legal guidance. Once I have this information, we can take the necessary steps to address the issue and protect your interests. Please provide the requested information at your earliest convenience so we can move forward promptly. Best regards,

if your bua ji has not filed a civil suit till now , you can file a civil suit for declaration of ownership and injunction against your bua ji so that your possession is not disturbed by them and you can properly claim the property as your own . otherwise you have to contest it when she files a case against you
