Family property dispute of 3 sons

23-Aug-2023 (In Property Law)
We are 3 brothers who resides together in a 3 floor House from more than 30 year's. That house is owned by father and currently alive. Now due to some issues if father suddenly give that entire house to one son so is it possible that son can forcefully ask other 2 sons to leave the house and what other 2 sons can do in that case to proof it as a fraud. This is the self owned property of the father legally on paper's but actually it was earned equally by 3 sons but there is no proof of that

a person in possession cannot be forcefully dispossessed and if that is being done, that itself would be illegal. if the father wants to give the whole property to just one son during his lifetime, it can only be done through a gift deed, release deed, etc. which is appropriately stamped and registered. if it's not, a valid transfer would not have taken place. regarding the proving of fraud, the surrounding circumstances have to be seen.

If you all have invested in the dwelling house then definitely you all possess equal right over the same. You can file suit for injunction in order to restrain your father from alienating the property to only one son. For any further legal assistance please feel free to contact Thanks
