Extreme discomfort due to chain smoker in upper floor in a high rize

We have a heavy smoker living just above us who smokes the whole day and late into the night . The smoke enters our room through windows and we are unable to open them for any sustained amount of time. Obviously the balcony is also inaccessible. We have tried making polite requests but to know avail. We have a young kid and want to know of we have any legal options to stop him from such behaviour
your first approach your apartment Association to restrict smoking in such a place where the smoke enters your living place . if they cannot enforce the restriction on the smoker then you can approach Court.
