for this you can file eviction suit regarding vacating of your property by tenant in court under whose jurisdiction your property comes in and you need to send them notice for the same prior filing the case against can also mention breach of trust

The first issue is identifying the governing State statute and matching the facts to its actual statutory ground. If the property is in Maharashtra, Section 13(1)(l) concerns the tenant’s acquisition or allotment of a suitable residence; it is not the subletting provision. If the property is in Delhi, the comparable subletting ground is Section 14(1)(b), which requires proof of subletting, assignment, or parting with possession without written consent. The tenant’s occupation of his wife’s flat for approximately seven years may be relevant to a Maharashtra claim under Section 13(1)(l), but only if the wife’s flat amounts to a residence acquired, allotted, or made available to the tenant and is “suitable” within the statutory test. The tenant’s age, family residence, or marital relationship alone does not prove that he surrendered possession of the rented premises or created a sub-tenancy.
