First of all get yourself properly represented in the court through a lawyer. Seek a detailed legal Consultation from a lawyer and Act in accordance with his considered opinion. Do share the details and brief a lawyer.

If you vacate in between the proceedings you must do it by taking permission of court and must negotiate with your owner wrt to dues. Negotiating with him might save you from legal fees recoverable by the owner if the decision is in his favour. However, to provide you with accurate advice I need to know the exact status of the suit. Feel free to contact me and provide me further details if you need better advice.
