Eviction of Illegally living family in Our House

My grandmother transfer her full property to my mother. Now my grandmothers Elder son and his family, who abused and beat my grandmother several times, is living in house which is now owned by my mother. How can we evict them legally without giving any share of property according to my grandmother? And Please tell me the advantages in making a Will in this case. So that they can't claim for share in future. Religion - Hindu

We can begin by shooting a strongly worded Legal Notice to your uncle asking him to vacate the premises ASAP failure of which shall lead to initiation of legal proceedings against them. A will is absolutely pertinent and necessary at this stage to further insure the share of the heirs of your mother. Further and better particulars are needed for an effective opinion.

I have perused your query and would advise you to issue a legal notice to the concerned seeking eviction. Followed by a Suit for mandatory Injunction and possession. This you have to follow to legally evict your uncle from the premises. Your mother should execute a Will to make the property secure. For further consultancy and legal services you may contact us.

in this case your grand mother have to take legal steps to evit the house. from his elder son .
for this she needs to move a petition in appropeiate forum so that the house can be evicted under the scheem if senior citizen wellfare as per law for this tou need proper advice of a lawyer.
