Does my mother have rights to claim her mother's ancestors property
16-Oct-2023 (In Property Law)
Hello, I'm the 4th generation here. Posting it on my mom's behalf. Does my mother have rights to claim her mother's ancestors property (which is still not in the name of my grandma and soon going to be there) while my mom's brother has taken power of attorney from my maternal grandmother. My mother is said no to her paternal property. Considering this my uncles are trying not to give her any share in maternal property as well. I want to know if my mom or I could claim for the property. Will there be any objections from my uncles or my grandma. Grandma stays with uncles hence can't take any decisions independently
according to the rulings of the court your mother has right to claim her share in the ancestors property. first of all you file a suit for partition and claim for separate possession. it will be solved postively
It all depends upon when your mother's mother died and whether she left a will on her property. If your maternal grandmother owned some property and your mother was alive on September 9, 2005, that is on the date when the amendment act of 2005 came into force, your mother and you have right over that property as ancestral property. If your maternal grandmother died before this new amendment and the ancestral property from your maternal grandmother was disposed off by her sons/husband, it is useless to think of this.
