02-May-2023 (In Property Law)
I m planing to buy a flat but later came to know that there is a civil procedure case between partners of flat for profit sharing . 1 lawyer told me court has ordered status quo on this flat and if I brought flat it can be invalidated. Opposite lawyer told me no such order is there and if we register the flat then no issues.i checked online about case status it stays pending for hearing and hearing will start next month no such info on status quo. Please tell me if court can order status quo without even hearing

If there is some dispute between the partners regarding some property and court case is going on.there can be status quo. You have to check the court case properly as well as orders granted by the court. If there is no status quo then you can buy after scrutiny of documents.

Yes court can order status quo exparte if court is satisfied that the matter needs status quo and the order of status quo is not going to adversely effect the opposite party. In any case if u already know that a litigation has started over the property and if u have not made any advance than u should better wait for the outcome of the court proceeding.

Hello, status quo means as on the date of the suit both the parties maintain the suit schedule property as it is. Please find out the last order and without hearing not possible. You can buy this property later on, but before buying this property please discuss with us with all relevant documents.
