Disputed property in Delhi DDA flat

07-Jun-2023 (In Property Law)
My mother had purchased a DDA flat in 1994 from property agent, but could not it get registered or any other written paper proof regarding being flat (house) was purchased by us but we have physical possession since that date to till now & and staying with family till now no any objection was raised by the owner .... my mother filed a court case against property agent in 2005/ Ipc act 451/324 however due to some circumstances she did compromise and closed to case but she haven't received paper as she had been promised by property agent and a few days later he disappeared. she's paying house tax .electicity b, water bills ( register with my mother name) she made her voter card in 1996 on the same address. after 15 years we found that property agent. now my mother wants to re-open the case or suggest us what we can do it in this matter. what are the chances to get our property pepper or suggest us so can start the process to get back our property paper

hello client as i can read ur issue its a very big issue and a big fraud has been played by tht property agent as the papers of the flat has been not handed over to your mother been the property owner of the same property . in this manner i can advice you tht instead of reopening tht case you should take higher degree steps to get him captured and he should hand over the documents to your mother in front of the high court so tht he can not play any fraud again with your mother and you mother is able to get the papers of her flat in her hands safly.

you need to file case against the properly dealer for giving the property documents and getting them registered in your favor and in your name. till the time no case is filed nothing can be done or you can again reopen the old criminal case by saying that the compromise terms were not adhered to so that case can be reopened.

Hi,

I need all the documents to suggest you a proper legal course.
As per your version the criminal case was settled in mediation centre of the court, you must have settled on the condition that the seller will get the property registered in your name.
So you need to file suit for specific performance.
