Dispute on daan patra land what to do

04-Jun-2023 (In Property Law)
I am Central Govt employee, posted in Goa. My native is Jharkhand. I am employed since 2012, and i had bought daan patra land on my wife's name. Now, we want to sell the Daan Patra land, but my eldest brother is creating dispute in this. He is filing case claiming that land is bought by income of Father, so liable to get divided. This amount or property which is on my wife's name is bought by father's income and not mine. If he files case, it will be huge harassment for we husband & wife, going and coming from Goa to Jharkhand. Now we both are working in Govt department, loss of holidays, up downs. How to avoid it, we also want my eldest brother to taste this pain, i want him to do up & down from hometown Jharkhand to Goa for some case, then only he will understand. Kindly guide.

Technically he should not make any claim. However, if he intends to make a claim, prevention is better than cure. It is advisable to issue him a legal notice at the threshold so that he does not initiate any legal action at all.

Venerated Sir,
I would like to inform you that as per the law of India if any property be purchased with the help of parent then all sons and daughters have right thereon but no one can challenge on self acquired property. You have right to give power of attorney to someone who will appear on your behalf so that you can free from ups and downs. You can also file case at Goa.. Feel free to call me.
