Developer promised us to give new flat but not received yet

Developer had entered into an agreement with me in the 2005 to provide me a flat on the same plot within 12mths.(Against my old flat measuring 340sq ft carpet area) Developer has so for not given me rent of alternate accommodation for 16months. Developer has not given me flat till now. He is not ready to give me the flat as per agreement (1. on the same plot 2.area of 340sq ft carpet) we had several meeting till now, the last meeting was at MP – BJP’s office (Shri Gopal Shetty) in the year 2015 where in developer agreed to give flat of 270 sq ft on another plot.

without the papers and reading the agreement signed with the developer, it is difficult to comment as we have check the terms. And the fsi allotted on the land, the details of the same has to be taken from the corporation. we can file a suit against him.

it is obligatory on the builder to give u the flat as per agreement. U also able to get the rent for alternate accommodation if that is mentioned in the agreement. U have to file complaint against the said builder in consumer court where u will get the necessary relief.

What is query is not disclosed. Still, it seem that promises are not fulfilled. If that is so then you Mau issue a legal notice for breach of trust and also under ownership flat act. Upon non compliance you prosecute all the parties by prosecuting them civil and criminal both way.
