Delayed SRA handover and rent issue

19-Jun-2025 (In Property Law)
My building went into redevelopment in May 2017, and it has now been over 8 years. I have not yet received possession of my flat. Despite multiple follow-ups, there has been no communication from the builder. The builder fails to attend society meetings and generally ignores calls and queries raised by committee members. Additionally, we have been receiving monthly rent from the builder, which has not been revised since 2020.and the rent payments have stopped entirely from January 2024.

If the developer has stopped paying rent and has not handed over the possession of the premises then you must approach the Court immediately. Feel free to contact me for seeking any legal advice/assistance as regards the same.

Well, a Legal Notice can be sent to the Builder asking for timeframe within which, he is likely to complete Redevelopment along with issuing him legal warning to release outstanding rent proceeds and to revise the rent figure along with rental contract, if Builder consents, well and good, if not, a case can be filed against him in Court.
