These cases are very common in Greater Noida, Delhi and other states of India. Legal options are always available for you. You have a right to claim back your hard earned money with interest as you are facing mental and physical agony because of Builder misdeeds. Cases related to defaulting builders should be first taken up by regulators under the new real estate law RERA before being referred to the NCLT for insolvency proceedings. At present, complaints against builders are being taken up by consumer courts as well as real estate regulatory authorities established under the RERA. Please understand if regulators under RERA fail to resolve, the dispute may be referred to the National Company Law Tribunal (NCLT) for adjudication. You can approach RERA. Query perused. I am of the considered opinion that you should first issue a legal notice to the concerned directors seeking refund within 15 days time, failing which you should file a complaint before rera through a lawyer and seek refund with interest.
