Delay in handover of flat by builder

As per the agreement entered with the builder in 2022, delivery of flat was due in Mar'26. Should I request for the due payments due to delay in delivery, if yes, what is the process? Builder is mentioning that they will handover flat in Oct'26 and then apply or OC. Also note that the builder has mentioned Jul'28 as the possession date even though they have committed mar'26 in agrements with customers.

Please review your Builder-Buyer Agreement and RERA registration details. If there is delay beyond the committed possession date, you may claim delay compensation/interest and issue a legal notice before pursuing appropriate legal remedies.

Yes. If the Builder-Buyer Agreement fixed possession for March 2026, you are entitled to claim compensation/interest for the delay, subject to the terms of the agreement and applicable law. First, issue a legal notice demanding timely possession, delay compensation, and complete disclosure regarding the Occupancy Certificate (OC). If the builder fails to comply, you may initiate appropriate proceedings before the RERA Authority or the Consumer Commission seeking possession, delay compensation, interest, and other consequential reliefs. A unilateral extension contrary to the contractual commitment can be legally challenged.
